1. Definitions
Customer means any individual, company, trust, partnership, contractor, business or other entity purchasing or seeking to purchase goods from Kazman Timber.
Goods means all products, materials and items supplied by Kazman Timber including timber products, fencing products, steel products, Colorbond® products, concrete sleepers, concrete plinths, gates, fabricated products and associated materials.
Kazman Timber, we, us or our means Kazm Homes Pty Ltd trading as Kazman Timber ABN 22 061 303 893.
Special Order Products means products specially ordered, custom manufactured, fabricated, cut, modified, processed or sourced specifically for a Customer and not ordinarily stocked by Kazman Timber.
Services means any cutting, fabrication, sourcing, powder coating, processing, transport coordination, delivery or other services provided or arranged by Kazman Timber.

2. Application of Terms
These Terms apply to all quotations, orders, sales, collections, deliveries, supplies of goods and credit arrangements undertaken by Kazman Timber.
These Terms prevail over any terms proposed by the Customer unless expressly agreed in writing by Kazman Timber.
Any supply of goods by Kazman Timber is conditional upon acceptance of these Terms.

3. Customer Acceptance
The Customer is deemed to have accepted these Terms upon the earlier of:
placing an order;
accepting a quotation;
requesting supply of goods;
making payment;
collecting goods;
accepting delivery of goods; or
continuing to deal with Kazman Timber after receiving notice of these Terms.

4. Quotations
Quotations remain valid for 30 days unless otherwise stated.
Kazman Timber may specify alternative validity periods where supplier pricing or market conditions require.
Quotations are based on information supplied by the Customer.
Quotations do not constitute a binding agreement until accepted by Kazman Timber.
Quotations are subject to product availability at the time of ordering.

5. Orders
Orders are not binding until accepted by Kazman Timber.
Kazman Timber may refuse, cancel or amend any order.
Customers are responsible for verifying all quantities, dimensions, specifications, colours and product selections before ordering.
Variations requested after ordering may result in additional charges or revised lead times.

6. Pricing
Unless otherwise stated, all prices are inclusive of GST.
Prices may change without notice prior to acceptance of an order.
Kazman Timber reserves the right to correct clerical, administrative, pricing, quotation, website or invoice errors at any time.
Correction of an error does not constitute a breach of these Terms.

7. Payment Terms
Unless approved for a trade account, payment is required before collection or delivery.
Accepted payment methods may include cash, EFTPOS, credit card and bank transfer.
Customers must verify bank account details before making payment.
Payment made to an incorrect account due to fraud or failure to verify details does not constitute payment to Kazman Timber.

8. Trade Accounts
Approved trade accounts are payable within fourteen (14) days from invoice date unless otherwise agreed.
Kazman Timber may suspend, reduce or cancel credit facilities at any time.
Overdue accounts may be placed on stop credit.

9. Retention of Title
All goods remain the property of Kazman Timber until all monies owing have been paid in full.
Until ownership passes, the Customer:
holds the goods as bailee for Kazman Timber;
must keep the goods identifiable;
must not grant any security interest over the goods; and
must allow reasonable access for inspection or recovery where lawful.

10. PPSR
The Customer acknowledges that these Terms create a security interest under the Personal Property Securities Act 2009 (Cth) and consents to Kazman Timber registering and maintaining that interest.

11. Delivery
Delivery dates and times are estimates only.
Delivery is deemed complete once goods are unloaded at kerbside or the nearest safe accessible location.
Customers are responsible for moving goods from the delivery point.
Kazman Timber is not liable for delays caused by traffic, weather, suppliers or circumstances beyond its control.

12. Site Access & Delivery Conditions
Customers must provide safe and suitable access for delivery vehicles.
Additional charges may apply where delivery cannot be completed due to unsafe conditions, inadequate access, obstructions or customer requirements.
Kazman Timber is not responsible for damage to driveways, landscaping, underground services or other property where access is requested by the Customer.

13. Crane Truck & Specialised Deliveries
Where crane trucks or specialised delivery services are arranged, customers are responsible for ensuring adequate access, ground conditions and unloading areas.
Additional charges may apply where deliveries are delayed, aborted or rescheduled.

14. Waiting Time & Failed Deliveries
Additional waiting, handling, re-delivery or administration charges may apply where deliveries cannot be completed due to customer actions or site conditions.

15. Collection of Goods
Customers collecting goods are responsible for ensuring their vehicle, trailer and restraints are suitable.
Kazman Timber may assist with loading but accepts no responsibility for:
load restraint;
transport suitability;
road law compliance; or
transport safety.
Once goods leave our premises, all responsibility passes to the Customer.

16. Third Party Carriers
Where goods are collected or received by a carrier, contractor, agent or representative nominated by the Customer, that person is deemed to be acting on behalf of the Customer.

17. Inspection, Acceptance & Claims
Goods must be inspected as soon as reasonably practicable.
Claims relating to shortages, damage, incorrect products or quantities must be made within 24 hours of collection or delivery.
Installation, cutting, modification or use of goods constitutes acceptance of the goods.

18. Storage of Orders & Customer Delays
Where goods are ready but collection or delivery is delayed by the Customer:
storage charges may apply;
handling and administration fees may apply; and
goods stored remain at the Customer’s risk.

19. Timber Products
Timber is a natural product and may contain variations in:
colour;
grain;
texture;
density;
moisture content; and
appearance.
Timber may naturally bow, twist, cup, split, check, shrink, expand or weather over time.
These natural characteristics do not constitute defects.

20. Colorbond® & Steel Products
Customers are responsible for confirming colours, profiles, dimensions and specifications before ordering.
Website images, brochures and colour representations are guides only and may vary from actual products.
Incorrect colour or product selection does not constitute grounds for return, exchange or refund.
Special-order Colorbond® products are non-returnable and non-refundable except where required by law.

21. Concrete Sleepers & Concrete Plinths
Concrete sleepers and plinths may contain:
dimensional tolerances;
colour variation;
hairline cracking;
efflorescence;
surface marks; and
minor chips.
These characteristics do not constitute defects where the product remains fit for purpose.
Kazman Timber is a reseller and not the manufacturer.
Customers are responsible for ensuring:
suitable engineering;
drainage;
footing design;
site preparation;
transport; and
safe handling procedures.
Once products have been loaded onto a customer’s vehicle or collected by a nominated carrier, all risk passes to the Customer.

22. Imported Products
Imported products may vary in appearance, finish, dimensions or packaging between production runs and shipments.
Minor variations do not constitute defects.

23–35 Product, Installation & Special Order Provisions
Customers are responsible for:
verifying measurements;
confirming specifications;
obtaining engineering advice;
ensuring site suitability;
ensuring proper installation; and
maintaining products appropriately.
Special-order products, custom fabricated products, cut-to-size products and modified products are generally:
non-cancellable;
non-returnable;
non-refundable; and
non-exchangeable,
except where required by law.

36–43 Returns, Refunds & Warranty Claims
Returns require prior approval from Kazman Timber.
Approved returns may:
attract restocking fees of up to 40%;
require the Customer to arrange return transport; and
be subject to inspection before approval.
Claims for shortages or damage must:
be submitted within 24 hours;
include clear photographs; and
be supported by sufficient evidence.
Manufacturer warranties remain the responsibility of the relevant manufacturer, subject to Australian Consumer Law.

44. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
Where permitted by law, Kazman Timber’s liability is limited to:
replacement of goods;
repair of goods;
supply of equivalent goods; or
payment of the cost of replacement or repair.

45. Limitation of Liability
To the maximum extent permitted by law, Kazman Timber shall not be liable for indirect, consequential, incidental or economic loss including:
loss of profit;
loss of revenue;
project delays;
increased construction costs;
loss of contracts; or
consequential losses arising from supply or use of goods.
Any liability shall not exceed the purchase price of the relevant goods.

46. Default & Recovery Costs
Overdue amounts accrue interest at 10% per annum calculated daily.
Customers must reimburse Kazman Timber for reasonable debt recovery, legal and enforcement costs incurred in recovering overdue amounts.
